Terms of Use
Last updated September 18, 2026
These terms govern your use of 3ammedia.net (the Site), which is operated by 3AM Media (3AM Media, we, us). By using the Site you agree to them. If you do not agree, please do not use the Site.
Section 10 contains a binding arbitration agreement and a class action waiver. It affects how disputes between you and us are resolved. Please read it.
1. What the Site is
The Site describes our social media and content services, shows examples of our work, and lets you contact us. Nothing on the Site is an offer to provide services. Any work we do for you is governed by a separate written agreement between you and us, and that agreement controls if it conflicts with these terms.
2. Our content and our clients' content
The Site's text, design and 3AM Media name and logo belong to us. The videos, posts, names and logos of our clients belong to those clients and appear here with their permission. You may view the Site and share links to it. You may not copy, republish or use our content or our clients' content for commercial purposes without written permission.
3. Results we describe
Figures on the Site, such as views, likes, followers, leads and sponsors, are real results from past work. They were reported by the platforms or by our clients as of the date shown. They describe what happened for those clients. They are not a promise or prediction that you will get similar results, which depend on many things outside our control.
4. Instagram, LinkedIn and other services
The Site links to, and shows content from, Instagram, LinkedIn and other third-party services. We do not control those services, and their own terms and privacy policies apply when you use them. View and like counts shown on the Site are copied from those platforms on the date shown and are not updated live.
5. Using the Site
Please do not:
- send spam, malicious code, or anyone else's personal information through the contact form;
- try to break, overload or gain unauthorized access to the Site; or
- scrape or copy the Site with automated tools.
6. Copyright complaints
If you believe something on the Site infringes your copyright, email info@3ammedia.net with: your name and contact details; the work you believe is infringed; the address of the material on the Site; a statement that you believe in good faith the use is not authorized by the owner, its agent or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will review it and remove material where appropriate.
7. No warranties
The Site is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise the Site will be uninterrupted, error-free or free of harmful components.
8. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Site. Our total liability for any claim relating to the Site is limited to one hundred US dollars (US$100). Some jurisdictions do not allow these limitations, so they may not all apply to you.
9. Indemnity
If you misuse the Site or break these terms, you agree to cover the reasonable losses and costs, including legal fees, that we incur as a result.
10. Arbitration and class action waiver
Try to resolve it with us first
Before starting any formal proceeding, email info@3ammedia.net describing the dispute and what you want. We will try in good faith to resolve it within 30 days.
Binding individual arbitration
If we cannot resolve it, you and we agree that any dispute, claim or controversy arising out of or relating to the Site or these terms will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in New York County, New York, or by video or telephone if the arbitrator allows. The arbitrator's decision is final, and judgment on it may be entered in any court with jurisdiction. The Federal Arbitration Act governs this section.
Exceptions
Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also ask a court for an injunction to stop infringement or misuse of intellectual property.
Class action waiver
You and we may bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate the claims of more than one person or preside over any form of class or representative proceeding.
Jury trial waiver
You and we each give up the right to a trial by jury.
Opting out
You may opt out of this arbitration agreement by emailing info@3ammedia.net within 30 days of first using the Site, with your name and the statement “I opt out of arbitration.” Opting out does not affect the rest of these terms.
If part of this section is unenforceable
If the class action waiver is found unenforceable for a particular claim, that claim will be decided in court under Section 11 and not in arbitration. The rest of this section still applies.
11. Governing law and courts
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any claim not subject to arbitration will be heard only in the state or federal courts located in New York County, New York, and you and we consent to their jurisdiction.
12. Changes
We may update these terms. The date at the top shows when they last changed. Continuing to use the Site after a change means you accept the updated terms.
